Aviation and Railroad Accidents

Aviation accidents (involving airplanes and helicopters) often result in death or catastrophic personal injury.

Many of these accidents are preventable and are caused by the negligence of others, as in the case of:

  • Defective manufacture or design of aircraft parts and components that fail while in flight, causing an aircraft to crash

  • Failure of air traffic controllers to alert pilots to bad weather or other flight traffic in the area

  • Negligent and incorrect instructions given by air traffic controllers

  • Pilot error, including:

  1. operating an aircraft at too fast or too slow of a speed
  2. operating an aircraft at too high or too low of an altitude
  3. negligently operating an aircraft (or attempting to take off or land) in bad weather
  4. failure to avoid a collision with fixed objects
  5. misinterpreting or ignoring the warnings and instructions of air traffic controllers

Railroad Accidents

A collision between a vehicle and a train almost always leads to a tragedy. Many of these accidents are preventable and at times are the result of negligence on the part of the railroad.

Some vehicle-train accidents have been caused by

  • Defective Railroad Crossings (alarms, flashing lights, and/or crossarms fail to operate)

  • Poorly Maintained Railroad Crossings (railroad companies fail to properly maintain the area; excessive vegetation obscures vision and prevents drivers from seeing an oncoming train)

  • Trains that are operated at an unsafe and excessive rate of speed

  • Trains that fail to properly signal their approach by blowing their whistle, as required by law
