Construction workerIf someone is injured in a construction accident, the architect, construction company or builder may be liable for the injury, depending on the legal duty owed by that company to the injured person. 

Employers are generally liable for injuries suffered by construction workers working on the employer's construction site. Bystanders injured in construction accidents may also recover from the persons who are at fault.

Profits at the Cost of Worker Safety

Like other businesses, many construction companies and builders have made the decision to seek more profits at the cost of worker safety. 

This means that some companies see lawsuits as just a cost of doing business and have made the financial decision that it is cheaper to settle lawsuits than it is to make the workplace a safer place in which to earn a living.

  • There have been too many fieldworkers dying due to heat stroke or dehydration because of the failure of the employer to provide sufficient drinking water.

  • There are too many workers who die on offshore oil rigs before medical help arrives, due to the employer’s delay in seeking medical help.

  • Additionally, many undocumented workers in the U.S. face harsh and oppressive working conditions, and also suffer the indignity of being afraid to complain.
